Terms of Service
These terms are an agreement between you and Warden AI ("Warden", "we", "us") about your use of the Warden app, the Warden website, your Warden account and the online services that come with them (together, "Warden"). Please read them. By installing or using Warden, or by ticking the box when Warden asks, you agree to them. If you don't agree, don't use Warden.
These terms include our Acceptable Use Policy, our Plans, Billing & Refunds terms and our AI Safety & Disclosures. Our Privacy Policy explains what happens to your information.
1. Who can use Warden
You must be at least 13 years old (or older if the law where you live sets a higher age for using services like this). If you're under 18, you need a parent's or guardian's permission, and they agree to these terms for you. You must be 18 or older, or have a parent or guardian do it for you, to buy a plan. If you use Warden for a company or other organisation, you're agreeing for it and confirming you have the authority to do so.
2. What Warden is
Warden is software that runs artificial-intelligence models on your own computer: it chats, talks out loud (Whisper), builds things (Forge), works your computer for you (On my screen), and helps with code and games. Most of its thinking happens on your computer. Some features use the internet: looking things up on the web, signing in, keeping your things in your account, using Warden from your phone, contacting support, and paying for a plan. Some of those rely on other companies' services, described in our Privacy Policy.
3. Your licence to use the software
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Warden software on computers you own or control, for as long as you follow these terms. You may not: copy, sell, rent or sublicense Warden; reverse engineer it, except where the law allows that regardless of this term; get around its plan limits, usage limits, licence checks or security; or use it to build a competing product from our code. Warden includes open-source components and openly licensed AI models. They're covered by their own licences, listed in "LICENSES & NOTICES" in Warden's folder, and nothing in these terms limits your rights under those licences.
4. Your account
You can use parts of Warden without an account. To keep your things across devices, or to buy a plan, you sign in with Google. Keep your Google account secure. You're responsible for what happens under your Warden account. Tell us straight away at aiwarden534@gmail.com if you think someone else is using it. You can turn off syncing or delete your account at any time (see the Privacy Policy).
5. Plans, billing and usage
Warden offers paid plans, currently Warden Plus and Plus Extra, and one-off purchases of points, as described in Plans, Billing & Refunds. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Plans renew automatically until you cancel. Plans include a number of points a day, which start again each day and don't carry over or have any cash value; bought points never expire. We may set reasonable limits to keep Warden working well for everyone.
6. On my screen and other actions on your computer
When you ask Warden to work your computer, you allow it to move your mouse, type, open programs and websites, read what's on your screen, and download, move or open files, as far as you've allowed in Settings. It acts on your instructions, and you're responsible for watching what it does and for the instructions you give it. Warden is built to stop and hand control back to you before it sends a message, posts something, buys or pays for something, signs in, or deletes anything. You can stop it at any time by moving your mouse, pressing Esc or pressing Stop. Other websites and programs have their own rules, and some don't allow automated use. Following those rules is your responsibility.
7. AI output
Warden's answers, code, pictures, voices, videos and other output ("Output") are produced by AI. Output can be wrong, incomplete, out of date or inappropriate, and it can sound confident when it isn't right. It is not professional advice. Don't rely on it for medical, legal, financial, safety or other important decisions without checking with a qualified person. Check code before you run it and anything important before you use it. Output may be similar to output other people receive. As between you and us, you own your input and, to the extent the law allows, the Output you create, and you're responsible for how you use it. Where the law requires it, AI-made pictures, audio and video are marked as AI-generated. Don't remove those marks, or present AI-made content of real people or events as real.
8. Your content
You keep ownership of what you put into Warden and what it makes for you. If you're signed in and syncing is on, or you contact support, you give us a limited licence to store, copy and transmit that content only to provide those services to you. We don't sell your content, use it for advertising, or use it to train AI models.
9. Acceptable use
You must follow our Acceptable Use Policy. In short: don't use Warden to break the law, hurt people, invade their privacy, deceive them, attack computers or abuse other services.
10. Other people's services and content
Warden can show you web pages, search results, pictures and other material from other sites, and it works with services such as Google, Paddle and Cloudflare. We don't control them and aren't responsible for them. Your use of them is governed by their own terms.
11. Our property and your feedback
Warden, its name, logo, design and software belong to us or our licensors and are protected by law. These terms don't give you any rights to them except the licence in section 3. If you send us ideas or feedback, we may use them without owing you anything.
12. Changes to Warden
Warden is updated regularly. We may add, change or remove features, and some may be labelled preview or beta. If we remove a paid feature in a way that significantly reduces what you paid for, you may cancel and ask for a pro-rated refund for the unused part of your billing period.
13. Ending this agreement
You can stop using Warden and delete it at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if we have to by law, or to protect people or our services. Where it's reasonable, we'll tell you first and give you a chance to fix things. Sections 7, 8 (for content already shared), 11 and 14 to 18 continue after this agreement ends.
14. Disclaimers
To the fullest extent the law allows, Warden is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Warden will be uninterrupted, error-free or secure, or that Output will be accurate. Some places don't allow these exclusions, so some may not apply to you.
15. Limits on our liability
To the fullest extent the law allows: (a) we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or business; and (b) our total liability for all claims relating to Warden is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100. Nothing in these terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence. If you're a consumer, you keep any rights you have under consumer law that can't be waived.
16. Indemnity
If you use Warden in breach of these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, to the extent the law allows.
17. Disputes
If you have a problem, contact us first at aiwarden534@gmail.com. Most things can be sorted out quickly, and we'll try in good faith to resolve it within 30 days. These terms are governed by the laws of the state where the developer of Warden is based and applicable United States federal law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the state where the developer of Warden is based, except that either of us may bring a claim in small-claims court. If you live in the European Union, the United Kingdom or another country whose law gives you the right to bring claims in your own courts under your own law, you keep that right.
18. General
These terms, and the policies they mention, are the whole agreement between you and us about Warden. If part of them can't be enforced, the rest still applies. If we don't enforce a part straight away, we haven't given up the right to. You can't transfer this agreement without our permission. We may transfer it to a company that takes over Warden. Export and sanctions laws apply to your use of Warden.
19. Changes to these terms
We may update these terms. If a change is important, we'll tell you in Warden before it takes effect, and Warden will ask you to agree again. If you don't agree, you can stop using Warden and cancel your plan.
